Terms of use and sale

About these terms

These terms are an agreement between you and Klyng of Ontario, Canada ("Klyng", "we", "us"). They apply to klyng.ca, klyngcup.com and klyngos.com. By using the sites, creating an account, placing an order or registering for an event, you agree to them. Our privacy policy explains how we handle your personal information.

Nothing in these terms takes away rights you have under the consumer protection laws of your province or state, including Quebec's Consumer Protection Act. Where those laws give you more protection, they apply.

Your account

• You must be at least 18 to create an account. Younger players can take part only with a parent or guardian's consent.
• Keep your details accurate and your sign-in private. You're responsible for what happens under your account.
• One account per person. Don't create accounts for other people without their permission.
• We can suspend or close accounts that break these terms.

Buying from klyng.ca

Prices and payment

• Prices are in Canadian dollars. Sales tax for your province is added at checkout and shown before you pay.
• We accept the payment methods shown at checkout. Payments are processed by Stripe.
• Discounts: one coupon per order. Bundle, look and team discounts apply automatically as shown in your bag, and the best one applies. Coupons have no cash value unless they say so.

Orders

• Your order is confirmed when we email you the confirmation.
• We may cancel an order and refund you in full if a product is unavailable, a price or description was clearly wrong, or we suspect fraud.
• Colours on screen may differ slightly from the real product.

Shipping

• We ship within Canada and to the United States. Rates and times are on our shipping page.
• Gear is made to order: about 7 business days to make it, then 10 to 14 days to deliver. These are estimates, not guarantees.
• Orders shipped outside Canada may be charged import duties or taxes on arrival. Those are the buyer's responsibility.
• Risk passes to you when the carrier delivers your order.

Returns and refunds

• Our returns page explains how to return or exchange gear within 14 days of delivery. It forms part of these terms.
• Defective gear is replaced or refunded. Contact us with photos.

About our gear

• Klyng compression wear and supports are sports apparel. They aren't medical devices and aren't meant to diagnose, treat, cure or prevent any medical condition.
• Compression levels and fabric details describe the product. They're not medical advice. If you have a medical condition, an injury, or circulation, heart or skin concerns, ask a health professional before wearing compression gear.
• Follow the size guide and the care label.

Klyng Cup events and leagues

Registration

• Before you play, you must accept the participant waiver. It's a separate legal agreement covering risk, medical care, conduct and media, and it's shown at registration.
• Entry fees, formats, eligibility and dates are shown on each event's page. We or the organizing club may change schedules, venues and formats when needed. We'll let you know.
• When a club runs its own event through Klyng, the club may be the seller of that registration and the payment may go to the club. The event page says who is running it.

Cancellations and refunds

• Each event's refund and withdrawal rules are shown at registration. If none are shown, contact us before the event and we'll handle it fairly.
• If we or the organizer cancel an event, you get a full refund of your entry fee.
• Removal for breaking the code of conduct is not refunded.

Team fees

• For team events, a team may agree at registration that Klyng can charge a saved card for later team fees, such as filling a short side. We only charge as described when you gave that permission, and we tell you before charging.

Results and ratings

• Results, standings and ratings are published on klyngcup.com.
• For rated events, results are submitted to DUPR. DUPR's own terms apply to your DUPR account.

Chat, photos and other content you post

• You keep ownership of what you post. You give us permission to host, show and share it on the sites so the service works.
• Don't post anything unlawful, abusive, hateful, harassing, misleading or private about someone else, or anything you don't have the right to share.
• We can remove content and suspend accounts that break these rules.

Using the sites

Don't:

• Try to access accounts, data or systems that aren't yours.
• Interfere with the sites, overload them or get around their security or limits.
• Scrape or copy the sites at scale, or use them to send spam.
• Use the sites for anything unlawful.

Our content

The Klyng name, logos, product designs, photos, text and software belong to Klyng or its licensors. You may share links and use the sites for your own personal use. Don't copy, sell or reuse our content without our written permission.

Other services

The sites link to and work with services run by others, such as DUPR, Stripe and Google. Their terms and privacy policies apply to them. We're not responsible for them.

Our responsibility

• We work hard to keep the sites accurate and available, but we provide them "as is". They may have errors or be unavailable at times.
• To the extent the law allows, we aren't liable for indirect or consequential losses, such as lost profits or lost data. Our total liability for any claim about a purchase or registration is limited to the amount you paid for it.
• These limits don't apply where the law doesn't allow them, including for consumers in Quebec, or to liability for our own gross negligence or wilful misconduct.
• Your risk at events is covered by the participant waiver.

Changes to these terms

We may update these terms. We'll post the new version here with its date, and tell you before a significant change applies. Orders and registrations follow the terms in force when you placed them.

Law and disputes

These terms are governed by the laws of Ontario and of Canada. If you're a consumer, you may also rely on the laws of the province or state where you live, and bring a claim in its courts.
